End User Licence Agreement

This agreement covers the Hunting Game app software — the thing you install on your phone or watch. The Terms of Service cover the game service itself, and the Privacy Policy covers your data. Read all three; they work together.

This agreement is between you and Jasper Aelvoet, sole trader, Belgium, enterprise number 1023.130.363, Klein Amerika 1B, 9930 Lievegem, contact@hunting-game.com. It is not an agreement with Apple or with Google.

Nothing in this agreement takes away rights you have as a consumer under Belgian or EU law.

1. Your licence

We give you a personal, non-exclusive, non-transferable, revocable licence to download and use the Hunting Game app on devices you own or control, for your own non-commercial entertainment.

On Apple devices this licence is limited to use on Apple-branded products you own or control, and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions — except that the app may be accessed by other accounts associated with you through Family Sharing or volume purchasing.

2. What you may not do

You may not sell, rent, sub-licence, lend or distribute the app; remove or alter any notice in it; use it to build a competing product; or use it in a way that breaks the law or the Community Guidelines.

You may not copy, modify, translate, reverse engineer, decompile or disassemble the app, or try to derive its source code — except to the extent that mandatory law gives you that right despite this clause. In the EU that includes your rights to make a back-up copy, to observe and study how the software works, and to decompile for interoperability. If you want interoperability information, ask us first at contact@hunting-game.com; we would rather just tell you.

3. Who owns what

We and our licensors own the app: the software, the design, the artwork, the name and the branding. This licence gives you permission to use it, not ownership of it. Anything not expressly granted here is reserved.

Content you create — your display name, profile photo and messages — remains yours, under section 7 of the Terms of Service.

4. Updates

We may issue updates, including over-the-air updates that install automatically. Some updates are needed to keep the app secure or working, and older versions may stop working after a reasonable period. Where you have bought Hunting Game Pro, we will supply the updates needed to keep it in conformity for as long as you are subscribed, and we will tell you about them.

5. Maintenance and support

We are solely responsible for maintaining and supporting the app. Apple and Google have no obligation whatsoever to provide any maintenance or support for it. Contact us at contact@hunting-game.com.

6. Warranty

We are solely responsible for any warranty relating to the app, whether express or implied by law, to the extent it has not been effectively disclaimed.

If the app fails to conform to any applicable warranty and you obtained it from the App Store, you may notify Apple, and Apple will refund the purchase price of the app to you (the app itself is free to download, so this will usually be nothing). To the maximum extent permitted by law, Apple has no other warranty obligation at all in relation to the app.

Your legal guarantee of conformity as a consumer, and the remedies in section 8 of the Terms of Service, are unaffected and are owed by us.

7. Claims about the app

We, and not Apple or Google, are responsible for dealing with any claim by you or any third party relating to the app or your possession and use of it. That includes product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar law.

8. Intellectual property claims

If a third party claims that the app infringes their intellectual property rights, we, and not Apple or Google, are solely responsible for investigating, defending, settling and discharging that claim.

You confirm that you are not located in a country subject to a US Government embargo, or designated by the US Government as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties. You will comply with any applicable export control laws.

10. Third-party terms

You must comply with the terms of any third-party service you use with the app — for example the Apple Media Services Terms and Conditions, the Google Play Terms of Service, and your mobile network provider's terms. The companies whose components are used in the app are listed in our subprocessor list.

11. Apple as third-party beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of this agreement, and upon your acceptance of it Apple will have the right — and is deemed to have accepted the right — to enforce this agreement against you as a third-party beneficiary of it.

12. Ending this licence

This licence lasts as long as you use the app. It ends if you delete your account, uninstall the app, or if we end it because you have seriously or repeatedly broken this agreement or the Terms of Service — in which case we will tell you why and, unless it would be unreasonable, give you a chance to put it right first.

When the licence ends, stop using the app and remove it from your devices. Sections 3, 6, 7, 8 and 13 continue to apply.

13. Responsibility for damage

Nothing in this agreement limits or excludes our liability for death or personal injury caused by our negligence, for fraud, for gross negligence or wilful misconduct, or for anything else the law does not permit us to limit or exclude. Section 13 of the Terms of Service sets out how responsibility for damage works, and it applies to this agreement too.

Please re-read section 5 of the Terms of Service before you play. Hunting Game moves you around the real world, and the app cannot see traffic, water or obstacles.

14. Law and disputes

Belgian law applies. If you are a consumer, this does not deprive you of the protection of the mandatory rules of the law of the country where you live. You may bring a claim in the courts of the country where you live or in Belgium; we may only bring one against you where you live. The out-of-court route in section 15 of the Terms of Service is open to you.
